Below is Our Basic Consignment Agreement
American Marble Auctions will act as an agent to sell your item(s) in accordance with the Uniform Commercial Code of Auctions. The marble(s) or item(s) will be photographed and listed in our auction catalog, sent to all prospective customers in addition to appearing online on our website catalog. The commission rate is as follows in regard to their final bid price. 15% for all items.
The items will be described accurately and with full disclosure as to condition. And the consignor agrees that the value of the item is the final bid amount. No expert’s opinion as to value will be accepted by either party to alter this agreement. A realistic assessment will be given but is only for reference.
No reserves are taken for any item unless previously discussed with American Marble Auctions. Any reserve agreed upon is the hammer price. That is the price a piece sells for or the winning bid amount. The Reserve will be protected to the specified amount and that price must be equaled or exceeded by the winning bid. All items are covered in our insurance policy, at no charge to the consignor. In an event that an item(s) are stolen, lost or destroyed, we will pay the consignor full appraised value.
We regret the possibility that an item might not appear due to circumstances regarding the marbles consigned or the auction itself. In the event an auction does not occur, the bottle will be returned to the consignor at no charge. American Marble Auctions will examine the piece soon after arrival and do our best to determine whether the exact description had been provided and to document any obvious flaws. However we reserve the right to make the final examination at the time the piece is cataloged to determine its condition. The consignor agrees to accept our grading and condition report. The item will either still be sold at the discretion of the consignor or returned at no charge.
Payment is made after payment is received from the buyer, and the buyer has had a minimum of three days to look at it. Generally, our consignors are paid within 3 weeks of the date of the auction but that can change depending on the number of marbles consigned and how quickly payments are received. We are not responsible for items being returned by the buyer. Generally if they are returned we will contact the underbidder for sale and or return the item.
All items are considered sold once the hammer falls, i.e. when the piece officially sells. Consignors who bid on their own property, whether they do it or have a proxy do it, will not be permitted to consign in the future. American Marble Auctions charges the buyer 15%, that is a fee for our services that goes to American Marble Auctions and is not included in the final price of the item sold, which a fee is charged for our services.
